SimplyTalk — Terms of Service

These Terms govern your use of SimplyTalk, a mobile application that translates messages and voice and video calls in real time between people who do not share a language. SimplyTalk is a product of PRO NEXTHOP LLC, a Florida limited liability company (document L18000218402), located at 7901 4th St N, STE 300, St. Petersburg, FL 33702, United States. By creating an account you accept these Terms.

1. The Account

• You must be at least 13 years old to use SimplyTalk.
• You are responsible for the security of your account and for the activity that takes place under it.
• You may delete your account at any time from the app's settings, or by writing to the address in section 9.

2. Phone Number Verification and SMS

Your phone number is your identity on SimplyTalk. As on other messengers, the number is how the people who already know you find you, so confirming it is part of setting up an account. SimplyTalk sends a single SMS containing a one-time verification code, and only after you have entered that number yourself in the app and tapped Send code. That tap is the consent, and it is the only thing that ever causes us to send you a verification code. The only other texts you can receive from us are the automatic replies to the keywords below, which you trigger yourself.

• We send no marketing, promotional or recurring messages, ever.
• Message frequency: one message per verification request.
• Message and data rates may apply, depending on your carrier plan.
• Carriers are not liable for delayed or undelivered messages.
• Reply STOP to opt out at any time, or HELP for assistance.

3. Translation

SimplyTalk translates automatically, using machine translation and speech services. Machine translation is imperfect: meaning can be lost, softened or changed. Do not rely on SimplyTalk for medical, legal, financial or emergency communication. The original text of every message remains available in the app alongside its translation.

4. Acceptable Use

You agree not to use SimplyTalk to harass, threaten, defraud or impersonate anyone; to send unlawful content; to send unsolicited bulk messages; or to attempt to disrupt, reverse engineer or gain unauthorised access to the service. We may suspend an account that does any of these.

5. Your Content

What you write and say remains yours. You grant us only the permission technically required to deliver, translate and display it to the people you send it to. We do not sell your content, and we do not use it for advertising.

6. Availability

SimplyTalk is offered "as is". It is under active development and parts of it are distributed for testing through Apple TestFlight. Interruptions, bugs and changes are expected. We do not guarantee uninterrupted service.

7. Third-Party Services

SimplyTalk relies on third parties to function, including Supabase for accounts and storage, LiveKit for real-time audio and video, OpenAI and Azure for translation and speech, Twilio for SMS verification, and Apple and Google for push notifications. Their handling of data is described in our Privacy Policy.

8. Liability

To the fullest extent permitted by law, SimplyTalk is not liable for indirect or consequential damages, nor for losses arising from an inaccurate translation, a message that failed to arrive, or a service interruption.

9. Changes and Contact

We may update these Terms; the date at the top always reflects the current version, and continued use after a change means you accept it. These Terms are governed by the laws of the State of Florida, United States.
